BALCA Can Remand

This Chapter addresses the important fact that, while the PERM Rule does not authorize BALCA to remand cases (as was specifically authorized in the pre-PERM Rule), the Board, nevertheless, has fashioned out an action to remand, sometimes utilizing terms like “return,” “vacate,” or even the term “remand” itself.
