Consideration by BALCA

BALCA may convene in panels of three judges or en banc to consider requests for review. BALCA can affirm the denial, direct the C.O. to grant certification, direct that a hearing be conducted on the application, or remand. The power to remand has been found to exist by BALCA, despite the fact that the PERM Rule does not provide the Board the power to remand.
